Legal Questions and Answers by Jonathan Stones of John Barkers
Question :-
A couple of weeks ago a young businessman ran into the back of my wifes car. The bump did not do a lot of damage to the car and whilst she was a little shaken, she was not hurt. However, his attitude just astounded her. After curtly asking if she was alright, he almost threw his business card at her and said I accept no liability and with that drove off, leaving her too it! Is there anything I can do about it?
Answer :-
He sounds very obnoxious but he has . . . just about . . . stayed within the law. He did check that you wife was not injured and he did leave his name and details. Insurance companies advise drivers not to admit liability, although he seems to have made a bit of a meal of it. Amongst the information he should have provided was his insurance details so, if he did not give those, a complaint could be made to the police. How seriously such an infringement of the rules would be taken is a matter of speculation but in any case the matter has to be reported within 24 hours. You could of course write to his company and outline your opinion of what happened. At least you would have the satisfaction of wiping the smile off his face.
