Legal Questions and Answers by Jonathan Stones of John Barkers
Question :-
I suffered a broken leg when a car being driven by my husband was involved in a crash. Unfortunately the accident was his fault and I have been advised that I should make a claim against him. It seems very odd to make a claim against your own husband in these circumstances, a little bit like money-grubbing.
Answer :-
If you were injured as a result of someone else's negligence you are entitled to make a claim against their insurance company. The fact that in this case the driver at fault was your husband is irrelevant.
I would advise that you enlist the help of a solicitor. From what you have said liability is clear-cut but the solicitor will help to assess the level of compensation to be sought and will negotiate with the insurance company, which obviously will wish to pay you as little as possible. All the major law firms in the area take personal injury cases on a no-win no-fee basis.
