Care Proceedings

Our specialist childcare solicitors also advise and represent parents and other family members and can provide advice even before care proceedings start.

We recognise how stressful it can be for all parents and family members involved in proceedings regarding their children. Our specialist childcare solicitors provide high quality advice, support, and representation in the most difficult and complex cases.

We have specialist accredited Law Society Children Panel lawyers who also represent children and Children’s Guardians in both proceedings brought by Childrens Services and in private disputes between parents where the court has directed that the children should be represented separately.

Legal aid is automatically available to all parents where Childrens Services apply for care and supervision orders and within the pre-proceedings PLO process. Legal aid may be available in other circumstances too and your solicitor will be able to confirm whether this applies to you. We offer competitive rates for those not eligible for legal aid.

What are care proceedings?

The local authority may start care proceedings to ensure the safety of a child deemed to be in danger. Their solicitors will then petition the court for a care order, which if granted, provides them with responsibility for the welfare of the child. The guardians and parents' legal representatives can contest the care order being granted by presenting their own case. If a care order is made, then the local authority's lawyers are responsible for taking decisions regarding care and placement for the child. Our legal team has extensive experience in representing both guardians and parents in care proceedings and can provide you with advice and support whenever needed.
