The Legal History of Milton Keynes

Milton Keynes is an English town located in the South East of England, approximately 50 miles north west of London. It was designated as a New Town in 1967 and has since grown to become a major commercial centre, with business parks and shopping centres clustered around its railway station. The development of Milton Keynes has been documented through legislation, which provides insight into the legal history of this unique town.

The Development Corporation Act 1969

The Development Corporation Act 1969 was passed to provide a framework for the development of new towns. Under this act, nine new towns were selected by the Government for development – including Milton Keynes – with each designated area having their own Development Corporation to manage their growth. The Development Corporation was made up of local representatives from the development area, as well as individuals appointed by the Government who would decide on planning and economic issues within Milton Keynes.

The Milton Keynes Borough Council Act 1974

In 1974, the Milton Keynes Borough Council Act was passed. This act provided for the establishment of a borough council in Milton Keynes – a body that would have all the powers of a district council but with additional authority over matters concerning economic development within its boundaries.

The New Towns Act 1981

The New Towns Act 1981 revoked many of the provisions of the Development Corporation Act 1969 and transferred many of its powers to the Milton Keynes Borough Council. This act allowed for the Milton Keynes Borough Council to have increased control over planning matters within the new town, as well as a greater say in economic issues.

The Local Government (Milton Keynes) Order 1984

The Local Government (Milton Keynes) Order 1984 was passed to provide further details on how local government in Milton Keynes should operate. This order provided additional flexibility for the Milton Keynes Borough Council, allowing it to take decisions on planning and economic matters that could not be taken under the New Towns Act 1981.

The Town & Country Planning (Milton Keynes) Order 1985

The Town & Country Planning (Milton Keynes) Order 1985 amended the regulations laid out in the Development Corporation Act 1969 and allowed for a greater degree of flexibility in Milton Keynes’ planning process. This order enabled the Milton Keynes Borough Council to take decisions on development proposals that would have previously been taken by the Development Corporation.

The Local Government Reorganisation (Milton Keynes) Order 1994

In 1994, the Local Government Reorganisation (Milton Keynes) Order was passed which provided for a further reorganisation of local government in Milton Keynes. This order abolished the existing borough council and established a new Milton Keynes Council, with responsibility for planning, economic development and other matters. The order also provided the Milton Keynes Council with more autonomy than its predecessor.
